Terms of Service (Terms & Conditions)

Governing Law & Jurisdiction: Laws of India. Exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

2.1 Introduction

These Terms of Service ("Terms") constitute a legal agreement between you ("User", "you", "your") and LearningPad Education Solutions Private Limited ("LearningPad", "we", "us", "our"). By registering for an account, accessing, or using the Platform you agree to be bound by these Terms, our Privacy Policy, and Cookie Policy.

If you do not agree with these Terms, do not use the Platform.

2.2 Eligibility

You must be at least 13 years old to create an account on LearningPad. Users aged 13–17 require verifiable parental or guardian consent to use the Platform. Users aged under 13 are not permitted to create accounts.

You must have the legal capacity to enter into contracts under applicable law.

2.3 Accounts, Registration & Security

You agree to provide accurate, current and complete information during registration and to update such data as necessary.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify LearningPad immediately of any unauthorized use.

Only one personal account per user is permitted unless expressly authorized.

2.4 Description of Services

LearningPad provides educational services including but not limited to: video courses, assessments, live classes, forums, class scheduling, dashboards for progress tracking, certifications, and institutional management tools.

We aim for high availability but do not guarantee uninterrupted access. We may suspend services for maintenance or for security reasons.

2.5 Modifications to Services

LearningPad may modify, improve, or discontinue features of the Platform at any time. We will use reasonable efforts to provide notice of material changes, but are not required to do so in every instance.

2.6 User Conduct & Acceptable Use

You agree to use the Platform lawfully. Prohibited conduct includes, but is not limited to:

  • Violating laws, intellectual property rights, or third-party rights
  • Uploading malware or malicious code
  • Attempting to probe, scan or test the vulnerability of the Platform, or to breach security or authentication measures
  • Impersonating another person or entity
  • Scraping, data mining, or automated extraction of any content
  • Posting obscene, defamatory, or offensive content
  • Harassment, threats, stalking or other abusive behaviour
  • Cheating, plagiarism, or facilitating academic dishonesty
  • Sharing account credentials for unauthorized use

Violations may result in account suspension or termination and legal action.

2.7 Intellectual Property Rights

All Platform content (course materials, videos, software, text, designs, logos) is owned by LearningPad or its licensors and is protected by Indian and international copyright, trademark and other intellectual property laws.

Users retain ownership of content they upload, but by uploading you grant LearningPad a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, adapt and display such content as necessary for Platform operation and promotion.

You may not reproduce, distribute, publicly display, or create derivative works from Platform content without prior written permission.

2.8 Payment, Pricing & Refunds

Pricing & Currency

Fees are displayed in Indian Rupees (INR) unless stated otherwise. GST and other applicable taxes will be shown at checkout.

Payment Methods

Credit/Debit Card, UPI, Netbanking, Wallets through PCI-DSS compliant third-party gateways. We do not store raw card data on our servers.

Subscriptions & Auto-Renewal

Certain services are subscription-based and auto-renew until cancelled. Users must cancel via Account Settings before the renewal date to prevent renewal charges.

Refund Policy (standard template)

  • Full refund if requested within 7 calendar days of purchase and if course consumption is less than 20%.
  • No refund after 20% of the course has been accessed or after 7 days of purchase, unless legally required.
  • Promotional purchases and certain one-time purchases (e.g., certifications) may be non-refundable unless defective.
  • Refunds will be processed to the original payment method within 7–10 business days after approval.

2.9 Cancellation & Account Termination

Users may cancel subscriptions via Account Settings. Cancellation takes effect at the end of the billing period.

LearningPad may suspend or terminate accounts for breach of these Terms, fraudulent activity, or other legitimate reasons. On termination, access to paid content will cease. Refunds will be issued only if legally required.

2.10 User-Generated Content & Moderation

LearningPad may monitor, review and remove content that violates these Terms or applicable law.

We are not responsible for user content and do not endorse user-generated content.

2.11 Disclaimers & Limitation of Liability

The Platform and content are provided "as is" without warranty of any kind. LearningPad does not guarantee specific educational outcomes, exam success, or employment.

To the extent permitted by law, LearningPad's aggregate liability to you for any claim arising from the Platform shall not exceed the amount you have paid to LearningPad in the 12 months preceding the claim, or ₹10,000, whichever is lower. This limitation may be revised following legal advice.

LearningPad is not liable for indirect, incidental, consequential, punitive or special damages.

2.12 Indemnification

You agree to indemnify and hold LearningPad and its officers, employees, agents and affiliates harmless from any claims, damages, losses, liabilities and expenses (including legal fees) arising out of your breach of these Terms, misuse of the Platform, or infringement of third-party rights.

2.13 Governing Law & Dispute Resolution

These Terms shall be governed by Indian law. Disputes should first be raised with [email protected] and will be addressed through informal resolution within 30 days. If unresolved, parties may opt for mediation and, failing that, arbitration in Hyderabad under the Arbitration and Conciliation Act, 1996 (venue: Hyderabad; language: English). Litigation in courts of Hyderabad is available as a last resort.

2.14 Force Majeure

LearningPad is not liable for failure or delay in performance due to circumstances beyond reasonable control, including natural disasters, strikes, acts of government, internet outages, cyber-attacks, or pandemics.

2.15 Severability & Entire Agreement

If any provision is found to be unenforceable, the remainder of the Terms remain in effect. These Terms, along with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and LearningPad.

2.16 Amendments

We may update these Terms from time to time. Material changes will be notified by email and in-app banners where feasible. Continued use after modification constitutes acceptance.
